You’ll file a claim with your insurance, they’ll handle the other party’s property damage, and the situation resolves without legal complexity. Your insurance company has lawyers if needed to defend against excessive claims.

The key factors that make DIY claims manageable are minor damages, no injuries, clear fault, and cooperative insurance companies. When all these align, adding a lawyer just reduces your settlement by their fee without adding meaningful value.

When You Definitely Need Legal Representation

Serious injuries change everything. If you or anyone else involved sustained significant injuries requiring hospitalization, surgery, or extended medical treatment, hire a lawyer immediately. The stakes are too high and the insurance company’s interests are too opposed to yours to go it alone.

Medical expenses can be substantial and ongoing. You need someone who understands how to properly value not just your current medical bills but future treatment needs, lost earning capacity, and long-term impacts on your quality of life. Insurance adjusters know most people underestimate these damages, and they take advantage of that knowledge.

And then there’s something called disputed liability, which creates another clear need for lawyering up. If the other driver claims you were at fault, or if fault is genuinely unclear, you need someone who can investigate, gather evidence, and build a case proving what actually happened.

When the other party lacks insurance or has inadequate coverage, the situation becomes legally complex. You might need to pursue your own uninsured motorist coverage or take legal action against the at-fault party personally. These scenarios require expertise most people don’t have.

Even in cases that seem straightforward, you face a pretty large power imbalance when dealing with insurance companies.

Initial settlement offers from insurance companies are almost always lower than what you deserve, banking on the fact that most people don’t know what their claim is actually worth. Without an attorney on your side, you might accept an offer that seems reasonable but actually undervalues your damages significantly.

What to Consider Before Hiring

Cost is the obvious concern. Most car accident lawyers work on contingency, taking a percentage (typically 33-40 percent) of your settlement or award. For minor accidents with no injuries, you can probably manage alone. For serious injuries, disputed fault, or significant damages, having a lawyer is always a good idea. Keep this in mind as you navigate through this process!
